Agreement
By using Herder, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service. Herder is provided as a lightweight planning tool for casual activity voting and scheduling.
Use At Your Own Risk
Herder is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of availability, accuracy, reliability, fitness for a particular purpose, merchantability, non-infringement, or that the service will be uninterrupted, secure, or error-free. You are responsible for verifying plans, results, votes, schedules, invitees, and any decisions made using the service.
No Critical Or Sensitive Use
Do not use Herder for emergencies, safety-critical coordination, professional advice, legal or medical decisions, employment decisions, financial decisions, or highly sensitive information. Herder does not guarantee delivery of emails, preservation of data, availability of links, accuracy of timezone handling, or that a response truly represents any particular person.
Your Responsibilities
You agree not to misuse Herder. This includes not:
- Submitting unlawful, harmful, abusive, deceptive, infringing, private, or sensitive content.
- Harassing others, impersonating others, manipulating votes, or disrupting activities.
- Attempting to access data, accounts, systems, or activities you are not authorized to access.
- Using the service in a way that violates applicable law or the rights of others.
User Content
You remain responsible for the activity details, names, votes, availability, support messages, and other content you submit. You grant Herder permission to store, process, display, transmit, and otherwise use that content as needed to operate, protect, and improve the service.
Limitation Of Liability
To the fullest extent permitted by law, Herder, its creator, operator, contributors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages, or for lost profits, lost data, lost opportunities, reputational harm, failed plans, scheduling mistakes, unauthorized access, service interruptions, or reliance on results. To the fullest extent permitted by law, any total liability for claims related to the service is limited to the greater of the amount you paid to use Herder in the 12 months before the claim or 100 US dollars.
Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Herder, its creator, operator, contributors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your use of the service, your content, your activities, your invitees, or your violation of these Terms or applicable law.
Changes And Availability
Herder may be changed, suspended, limited, or discontinued at any time. Features may change, and data may be modified or removed as needed to operate the service, enforce these Terms, respond to abuse, or comply with legal obligations.
